The State with the rules of law

Today’s society has passed through stone age and has achieved modernization. People has started to live in a group, they share every emotion with each other. In simple, human society now is civilized. Works are being divided to remove excessive burden only from one and this has made life easier. With the view of settling all within the boundaries, rules and regulations are made. Knowingly, the group of people has changed into society and society to state and law started from the division of works. The main motive of the development of law and state was to live under one family with a clear vision of presenting helpful hands.

Relation of state with that of the law is full of complexity in any case of misinterpretation. If one has the clear figure about state’s law then it will

be easier to understand its functioning. Any subject matter relating to state and its people like population, government, sovereignty and territory are permanent. Rules of the state are meant to be made for people, to protect their rights and ensure equality. Very often rules are being misused and are being used by the rulers for self-benefit instead of using it for the development of the nation and social welfare. Because of this there was a contradictory relationship between the rulers and ruled. Due to this situation, state and, its government failed to maintain peace and function in a systematic manner. The failure of the government then results in the dispute and class struggles and the situation went out of control of running law. In order to balance the situation state with the systematic law maintaining peace, classes disputes, equal opportunity to all and justice was proposed. And then the constitution was formed, Constitution the very strong law for the nation was made which resembles equal justice for all and equal opportunities for all. The country that functions in accordance with the constitution is meant by the state with the rules of law.

The state with rules of law has same eyes upon all which includes every citizen are respected and the decision would be made with the involvement of mass agreement, facilities to the citizens would be made on the basis of the majority decision. On the other hand minority decision too will not be ignored. The minority decision is given due honor. There are other laws making subordinates bodies too that assist state when other rules are to be implemented asides from the directives of the constitution in the case when needs are to be met.

In a state with rules of law every citizen, society, organization is legalized within the boundary of rules and constitution made by the state no one has right to function against it neither none is above then the state’s law. The law states is the very strong entity in itself hence no single person possess any capability to change it but in any cases of significant effort mass participation would be effective. And this is possible only in a democratic country through major participation and proper planning.

There are three legal organs of government in a democratic country and they are :-

  • The Legislative
  • The Executive
  • The judiciary

An officially elected or otherwise selected body of people vested with the responsibility and power to make laws for a political unit, such as a state or nation is meant by legislative. In legislative executive, communications originate from the executive branch. Its main function is to make law. Executive executes the laws made by the legislature. It comprises of- The Prime Minister together with all the other ministers both senior and junior. Judiciary is the system of courts that interprets and applies the law in the name of the state. The judiciary also provides a mechanism for the resolution of disputes. Its main function is to settle down the disputes with their district jurisdictions activities. However, these three organs are independent of each other. Legislative own certain power over executive and judiciary. Its supervises executive and judiciary in certain cases for having access to direct representatives of the people. Legislative the law making body helps in the arrangement for the preservation of the fundamental rights of the citizen, too.

The great event takes place in 2007BS when the state of ruling the country on the basis of written law began in Nepal.

When the state of the ruling was based on written law it primarily focused on proper rules and regulations. It brought concept about facilitating people with proper means of freedom, equality and adequate use of fundamental rights. Its major focus was on making people’s life easier through maintaining peace, ensuring the happy life of people and prosperous living and developing public welfare.

In order to protect people’s rights, preserve their existence and ensure freedom rule of law plays the significant role. Rule of law aid to make society civilized and for this, it manages all the citizens to be under the certain obligation of the law of the state where none of the people could act like superior to that of the law of the state. It doesn’t allow any of the people to act in an anonymous way. Every action is carried out as per the prevalent rules and regulations of the state. This improvement in people’s life helps to create the society referring equal justice and equality. Hence, the clear form of constitution of Nepal supports the concept of the rule of law.
